Terms & Conditions

Convenience translation. The German version is legally binding.

§ 1 Scope and contracting party

These terms and conditions apply to participation in the DermaToken rewards programme (the “Programme”). The Programme is operated by, and is the sole responsibility of, Token Engineering Labs GmbH, Ruthnergasse 145, 1210 Vienna, Austria (“we”, “TEL”). Your contracting party for participation is TEL alone.

Dr. Khalifa's practice (the “Practice”) is not a contracting party, operator or controller of the Programme. It acts as a cooperation partner only, helping to hand out QR codes and rewards. Participants are natural persons aged 18 or over.

§ 2 What the Programme offers

Participants receive badges confirming a visit, service or milestone, and reward points (“DERMA”) that can be redeemed for the practice's rewards. Badges are personal. DERMA can be transferred to other participants; transfers take effect immediately and cannot be reversed.

Badges and DERMA are recorded on a public blockchain (Base) (see Privacy Policy, section 5).

§ 3 Participation

Participation is through our sign-in service (email, Google account or your own wallet), through which a wallet is created or connected for you. Please keep your sign-in details safe; they give access to your badges and DERMA.

By participating you confirm these terms and the Privacy Policy. Participation is voluntary and can be ended at any time.

§ 4 Test phase

The Programme is in a test phase. It is still under development, may contain bugs, interruptions, security gaps and vulnerabilities, and is not optimised in all respects. Features, rewards, balances and badges may be changed, reset, restricted or discontinued at any time, without compensation. Availability of the Programme is not promised.

By participating you confirm that you have read these terms, understand and accept the test nature of the Programme, and use it at your own risk. To the extent permitted by law, you waive claims against TEL and the Practice arising from malfunctions, data loss, loss or worthlessness of balances or badges, and security gaps and vulnerabilities in the Programme, the wallet infrastructure and the blockchain.

Please only commit what you are prepared to lose, and report anything unusual to office@tokenengineeringlabs.com.

§ 4a DERMA

DERMA is a bonus and loyalty points system. DERMA has no monetary value, is not a currency, security or investment, and is not redeemable for money. There is no legal entitlement to particular rewards, reward amounts or availability.

§ 5 Earning and redeeming

You receive badges and DERMA by scanning the practice's QR codes or through entry by the practice team. QR codes are time-limited and single-use. Redeemed DERMA are retired. Rewards are offered voluntarily and revocably; TEL may adjust rewards, prices and earning conditions at any time for the future.

§ 5a Referral programme

Every participant has a personal invite link and code. Anyone who joins through them is assigned to the inviting person; the first assignment stays. Assignment is possible through a link for new accounts, and through a code also at a later time.

For spends of the invited person from the time of assignment, the inviting person receives additional DERMA equal to a percentage set by TEL. The invited person's DERMA remain unchanged.

Referral rewards are credited in a weekly batch. Inviting persons see their total and the number of their referrals. TEL may adjust the percentage and conditions for the future.

§ 6 Use

We ask that the Programme is used as intended. In case of misuse, participation can be ended.

§ 7 Medical treatment

Participation is independent of any medical treatment. The Programme is not a medical service; the Practice accepts no responsibility for it.

§ 8 Changes

We keep developing the Programme. We will tell you about changes to these terms in the app and ask for your confirmation.

§ 9 Liability

TEL alone is responsible for the operation, technology, data processing and content of the Programme. Claims relating to the Programme are to be directed exclusively at TEL; to the extent permitted by law, the Practice is not liable.

During the test phase (§ 4), TEL is liable only for intent and gross negligence and for personal injury. Otherwise liability is excluded to the extent permitted by law. Mandatory statutory liability provisions remain unaffected.

§ 10 Data protection and applicable law

Information on the processing of personal data is in the Privacy Policy.

Austrian law applies; mandatory consumer protection provisions remain unaffected.
